Judge Penney has earlier enrolled in ROTC program at Old Dominion University and at that time she started working as a public servant. While completing her education at Old Dominion University she along it served in the US Army as Marine Corps for four years.
She then got her certificate from George Mason University got the opportunity to serve as Commonwealth Attorney and worked for five years in this position. Judge Penney Azcarate then in between also served as a Private practicing attorney. In 1998 she was admitted to the Virginia bar, from 1998 to 2000 she was positioned as a Staff Attorney for American Prosecutors Research Institute.
From 2000 to 2005 she worked as Assistant Commonwealth Attorney at Fairfax county.
